1. About This Policy
This Privacy Policy describes how Mindful Vessel collects, uses, discloses, and protects personal information when you visit or buy from our website and online store, interact with our social media pages, sign up for our email or text message programs, contact customer support, or otherwise interact with us, and the privacy choices available to you. Our current product is Mindful Oil, a 10 ml frankincense and myrrh roll-on, sold in single and multi-pack variants directly through our website and, where offered, through online marketplaces such as TikTok Shop. Our store is powered by Shopify, as described in Section 11. By using the Services, you agree to this Policy. If there is a conflict between our Terms of Service and this Policy, this Policy controls with respect to the collection, processing, and disclosure of your personal information.
2. Your Choices at a Glance
You can: unsubscribe from marketing email using the link in any message; reply STOP to opt out of text messages; opt out of the sale or sharing of your personal information and of targeted advertising using the “Your Privacy Choices” link in our footer or by broadcasting a Global Privacy Control signal; and exercise data rights such as access, correction, and deletion by emailing info@mindfulvessel.com. These choices are explained in detail below.
3. Personal Information We Collect
Depending on how you interact with us, we may collect the categories of personal information described below. The table maps these to the categories defined under the California Consumer Privacy Act, as amended (the “CCPA”), and indicates whether we collect each category and whether it may be “sold” or “shared” as those terms are defined by California law (which, as explained in Section 12, can include the use of certain advertising and analytics technologies).

We do not seek sensitive personal information. If you voluntarily provide it (for example, in a support message), we use it only for the purpose you provided it and then delete or restrict it, and we do not use it to infer characteristics about you. We do not knowingly collect personal information from anyone under 13, and we do not offer accounts, purchases, or marketing sign-ups to anyone under 18.
4. How We Collect Personal Information
We collect personal information: directly from you, when you place an order, create an account, contact us, sign up for marketing, submit content, or respond to a survey; automatically from your device, through cookies, pixels, and server logs; and from third parties, including our store platform (Shopify), payment processors, fulfillment provider, analytics and advertising partners, and fraud-prevention vendors. Where you choose to interact with us through a social media or marketplace platform, we may receive information from that platform consistent with its settings and policies.
5. How We Use Personal Information
We use personal information for the following business and commercial purposes:
• Provide and operate the Services, including processing and fulfilling orders, processing payments, operating accounts, and managing returns and refunds;
• Provide customer support and respond to your inquiries;
• Communicate with you, including transactional messages and, with your consent where required, marketing email and text messages;
• Market and advertise, including showing and measuring advertising, sending offers and promotions, building audience segments, and performing attribution and analytics;
• Personalize and improve the Services, products, and your experience, including through testing and product development;
• Maintain security and prevent, detect, and investigate fraud, abuse, and violations of our Terms;
• Comply with law and legal process and protect our rights, your rights, and the rights of others.
We may use automation and artificial intelligence tools to support these purposes, as described in Section 18, and we may create and use de-identified or aggregated data, which does not identify you, for analytics and to improve our products and services.
6. Cookies, Pixels, Analytics, and Advertising Technologies
We and our partners use or may use cookies, pixels, tags, software development kits, and similar technologies to operate the site, remember your preferences, understand how the site is used, personalize content, deliver and measure advertising, perform attribution, and prevent fraud. These technologies generally fall into the following categories:
• Strictly necessary. Required to operate the site, process orders, and maintain security. These cannot be turned off through our preference tools.
• Analytics. Help us understand how visitors find and use the site.
• Functional. Remember choices and improve your experience.
• Advertising. Used to deliver and measure relevant advertising. We may use advertising and analytics technologies and partners, which may include Shopify, Google, Meta, TikTok, and our email and text message platform, Klaviyo, and we may add or change providers over time.
You can manage non-essential cookies and your sale and sharing choices through the “Your Privacy Choices” link in our footer, and you can block or delete cookies through your browser settings, although some features may not function if you do.
7. Do Not Track and Global Privacy Control
Some browsers offer a “Do Not Track” signal. Because there is no common industry standard for responding to it, we do not currently respond to Do Not Track signals. However, we do honor the Global Privacy Control (GPC) signal as a valid request to opt out of the sale and sharing of personal information for the browser or device on which it is enabled, as described in Section 12. 8. Your Advertising Choices
In addition to our footer link and GPC, you can opt out of interest-based advertising from participating companies through the Digital Advertising Alliance at optout.aboutads.info and the Network Advertising Initiative at optout.networkadvertising.org, and you can adjust ad settings within platforms such as Meta, Google, and TikTok. Opting out does not mean you will stop seeing ads; it means the ads you see may be less relevant.
9. Email and Text Message Marketing
Email. If you provide your email address and submit a form or click a call to action, you agree to receive marketing emails from Mindful Vessel and the service providers acting on our behalf. Each marketing email identifies Mindful Vessel as the sender, includes our mailing address, and offers a way to unsubscribe, which we honor promptly.
Text messages. If you affirmatively opt in, you agree to receive recurring automated marketing text messages from Mindful Vessel at the number you provide, including messages sent using an autodialer. Consent is not a condition of purchase. Message and data rates may apply, and message frequency varies. Reply STOP to cancel and HELP for help. We log your consent, including the date, the form used, the consent language shown, and the phone number provided. Our full text message program terms are in our Terms of Service and are incorporated into this Policy.
10. How We Disclose Personal Information
We may disclose each category of personal information identified in Section 3 to the following categories of recipients:
• Service providers and processors that perform services for us, such as our store platform and hosting (Shopify), payment processing, order fulfillment (our third-party logistics provider), email and text message delivery (Klaviyo), analytics, advertising operations, and fraud prevention;
• Advertising and analytics partners that help us deliver and measure advertising and perform attribution, subject to the opt-out choices in Section 12;
• Marketplaces and platforms through which you choose to interact with us or purchase, such as TikTok Shop, subject to their own policies;
• Legal and safety recipients, such as law enforcement or other parties, when required by law or legal process or to protect rights, safety, and security;
• Corporate transaction parties, such as a successor or acquirer in connection with a merger, financing, or sale of assets;
• Other parties with your consent or at your direction.
We may also disclose de-identified or aggregated information that does not identify you.
11. Relationship with Shopify
Our store and the Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for us and for you. Information you submit through the Services is transmitted to and shared with Shopify and may be processed by Shopify and its service providers, which may be located in countries other than where you live. To help operate, protect, and improve our business, we may use certain Shopify enhanced features that use data and information about your interactions with our store, other merchants, and Shopify. For those features, Shopify is responsible for its own processing of your personal information, including responding to related rights requests. 12. Sale or Sharing of Personal Information; Targeted Advertising
Some state privacy laws define “sale” broadly to include disclosing personal information in exchange for value, and “share” to include using it for cross-context behavioral advertising. To the extent we use advertising and analytics technologies, such as the cookies and pixels described in Section 6, that activity may be considered a sale or sharing under these laws. The categories of personal information that may be sold or shared are identified in the table in Section 3 (categories A, D, F, G, and K). We do not sell or share for monetary consideration, and we do not sell or share the personal information of anyone we know to be under 18.
To opt out of the sale or sharing of your personal information and of targeted advertising, use the “Your Privacy Choices” link in our footer, or broadcast a Global Privacy Control signal, which we honor for the browser or device on which it is enabled. After you submit an opt-out request, we will provide a confirmation that the request has been received and applied. Nevada residents may email info@mindfulvessel.com with “Nevada Opt-Out” in the subject line to request that we not sell covered information as defined by Nevada law.
13. Your Privacy Rights
Depending on your state of residence, you may have the right to:
• Know or access the categories and specific pieces of personal information we have collected about you, the sources, the purposes, and the categories of recipients;
• Delete personal information we have collected from you, subject to legal exceptions;
• Correct inaccurate personal information we maintain about you;
• Obtain a portable copy of certain personal information;
• Opt out of the sale or sharing of personal information and of targeted advertising;
• Limit the use of sensitive personal information (note: we do not use sensitive personal information for purposes that trigger this right);
• Appeal a denial of a request, where your state provides an appeal right; and
• Be free from unlawful discrimination for exercising your rights.
14. How to Exercise Your Rights
You may exercise your rights by using the “Your Privacy Choices” link in our footer (for opt-outs and cookie choices), by broadcasting a Global Privacy Control signal, or by emailing info@mindfulvessel.com with your request. We will take reasonable steps to verify your identity, for example by matching information you provide to information in our records, before fulfilling a request to know, delete, or correct. You may use an authorized agent to submit a request where the law allows, and we may require the agent to provide proof of authorization and may verify your identity directly. We will respond within the time required by applicable law, and where an appeal right applies, we will provide instructions for appealing a denial. We will not discriminate against you for exercising your rights. 15. State-Specific Disclosures
If you are a resident of a state with a comprehensive privacy law (such as California, Virginia, Colorado, Connecticut, Utah, and a growing number of other states), you may have some or all of the rights described in Section 13, subject to that state’s law. As a matter of practice, we extend the core rights and opt-out choices described in this Policy to our customers regardless of state. References in this Policy to “sale,” “share,” “targeted advertising,” and “sensitive personal information” should be read consistently with the law of your state.
16. Additional California Disclosures
16.1 Notice at Collection
The categories of personal information we collect and the purposes for which we use them are described in Sections 3 and 5. We collect this information for the business and commercial purposes listed and retain it as described in Section 19. The categories that may be sold or shared are identified in Sections 3 and 12, and you may exercise the opt-out described in Section 12.
16.2 Shine the Light
California residents may request information about our disclosures of personal information to third parties for those third parties’ own direct marketing during the prior calendar year by emailing info@mindfulvessel.com with “Shine the Light Request” in the subject line. We will respond as required by law. If we do not disclose personal information for third-party direct marketing, we will say so.
16.3 Minors
If you are a California resident under 18 and have posted content on our website, you may request its removal by contacting info@mindfulvessel.com. Removal may not be complete if the content has been reposted by others or if retention is required by law.
17. Notice of Financial Incentive
From time to time we may offer a benefit, such as a discount on your order or another offer, in exchange for signing up for our email or text message program, which involves your providing personal information such as your email address or phone number. This may be considered a “financial incentive” under California law.
• How to opt in: submit your information through the relevant sign-up form.
• How to withdraw: unsubscribe from email using the link in any message, or reply STOP to text messages, at any time.
• Material terms: the specific discount or benefit and any conditions are described at sign-up.
• Good-faith estimate of value: we estimate that the value of the personal information you provide is reasonably related to the value of any offered incentive to us, which we calculate based on the expense of the incentive and the increased engagement and sales the program is expected to generate. Participation is entirely voluntary, and you may withdraw at any time.
18. Automated Decision-Making and Profiling
We may use automation and artificial intelligence tools to support tasks such as fraud screening, product recommendations, customer service workflows, analytics, and marketing. We do not use these tools to make decisions that produce legal or similarly significant effects about you without human involvement. Where applicable law provides rights regarding automated decision-making or profiling, we will honor them.
19. Data Retention
We retain personal information only as long as necessary to fulfill the purposes described in this Policy or as required by law, accounting, tax, or compliance needs, after which we delete or de-identify it. To determine the retention period, we consider the nature and sensitivity of the information, the purposes for which we use it, applicable legal requirements, and the potential risk of harm from unauthorized use or disclosure.
20. Security
We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit, tokenized payments through our processors, and access controls. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your account credentials confidential.
21. Where Your Information Is Processed
We operate in the United States, and the Services are intended for use in the United States only. We do not intentionally offer or ship our products outside the United States. Our service providers, including Shopify, may process or store personal information in countries other than where you live. If you access the Services from outside the United States, you do so at your own risk and are responsible for compliance with local laws.
22. Children’s Privacy
We do not knowingly collect personal information from children under 13, and we do not offer accounts, purchases, or marketing sign-ups to anyone under 18. As of the Effective Date, we do not have actual knowledge that we sell or share the personal information of individuals under 16. If we learn that we have collected personal information from a child under 13, we will delete it. If you believe a child under 13 has provided us personal information, contact info@mindfulvessel.com.
23. Third-Party Links and Services
The Services may link to or integrate with third-party websites, platforms, and services that we do not control, including payment processors, fulfillment carriers, social media, and marketplaces such as TikTok Shop. This Policy does not apply to those third parties, and we are not responsible for their privacy practices. We encourage you to review their privacy policies.
24. Complaints
If you have a complaint about how we process your personal information, contact us using the details below. Depending on where you live, you may have the right to appeal a decision by contacting us, or to lodge a complaint with your state attorney general or local data protection authority.
25. Changes to This Policy
We may update this Policy from time to time, including to reflect changes to our practices or for operational, legal, or regulatory reasons. When we do, we will revise the “Last Updated” date and post the updated Policy on this page, and, where required, provide additional notice. Your continued use of the Services after an update means you accept the revised Policy.
